Terms & Conditions

1. Introduction
These Terms and Conditions ("Agreement") govern your use of the services provided by 

Ascend Aerials

 ("Company," "we," "us," or "our"). By engaging our services, you ("Client," "you," or "your") agree to be bound by this Agreement. This document also incorporates our Privacy Policy, detailed below, which explains how we handle any personal data captured during our operations. 

2. Qualifications and Standards

  • A2 Certificate of Competence (A2 CofC): Our drone operators are certified with the A2 Certificate of Competence, which permits us to operate drones weighing up to 2kg in the Open Category (A2 subcategory).

  • Compliance: We operate in strict adherence to all applicable UK Civil Aviation Authority (CAA) regulations, including the Drone and Model Aircraft Code. 

3. Scope of Services
Ascend Aerials provides aerial solutions using advanced DJI drone technology, including but not limited to:

  • Rooftop inspections.

  • Real estate photography and videography.

  • Other bespoke aerial applications. 

4. Flight Operations and Safety

  • Safety First: All flight operations are subject to factors such as weather conditions, air traffic restrictions, and on-site safety assessments. We reserve the right to reschedule or cancel flights to ensure the safety of our personnel, equipment, and the public. We will not operate over crowds or closer than 50 meters horizontally to uninvolved people with drones weighing between 500g and 2kg, in accordance with our A2 CofC permissions.

  • Client Cooperation: The Client must provide our team with safe access to the project site and ensure that any required landowner permissions for takeoff and landing are secured in advance. 

5. Pricing and Payment

  • Quotation: All services are provided based on a written quotation valid for a specified period.

  • Payment Terms: Payment terms, including the schedule and method of payment, will be outlined in your project quotation. We reserve the right to withhold deliverables until full payment has been received. 

6. Client Responsibilities

  • Permissions: The Client is responsible for obtaining any necessary permits or permissions from landowners and other relevant parties.

  • Site Safety: The Client must ensure that the project site is safe for our team to operate.

  • Scope Changes: Any changes to the project scope must be communicated in writing and may incur additional charges. 

7. Deliverables and Ownership

  • Deliverables: The final imagery, data, or video will be provided to the Client in the formats and timeframe specified in the project quotation.

  • Intellectual Property (IP): Unless otherwise agreed upon in writing, Ascend Aerials retains the copyright to all IP created. We grant the Client a perpetual, royalty-free license to use the deliverables for the agreed-upon purpose, such as marketing a specific property.

  • Promotional Use: The Client agrees that Ascend Aerials may use the captured footage for its own promotional and marketing purposes, such as on our website or social media. 

8. Liability and Insurance

  • Limitation of Liability: Our liability is limited to the cost of the services provided.

  • Insurance: Ascend Aerials holds appropriate third-party liability insurance, a requirement for commercial drone operators in the UK.

  • Client Indemnity: The Client agrees to indemnify Ascend Aerials against any liability, loss, or damage resulting from the Client's failure to adhere to the terms of this Agreement. 

9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom.
